It is evident from the very text of the narrative that it was never known until the battle of Jamal took place in 36 AH. It was brought forward only after \u2018\u0100\u2019ishah (rta) faced \u2018Al\u012b (rta) in battle. Before that, it was never heard of \u2013 which of course is quite strange.<\/p>\n\n\n\n<p>2. One of the narrators is \u2018Awf ibn Ab\u012b Jam\u012blah about whom scholars of <em>rij\u0101l<\/em> know that he used to give preference to \u2018Al\u012b (rta) over \u2018Uthm\u0101n (rta) and it is also known that since \u0100\u2019ishah (rta) sided with \u2018Uthm\u0101n (rta), a group of the followers of \u2018Al\u012b (rta) targeted her to besmear her character. Moreover, the Had\u012bth can never be applied to the case of \u2018\u0100\u2019ishah (rta) since she never claimed to be the ruler of the Muslims.<\/p>\n\n\n\n<p>3. It is a <em>ghar\u012bb <\/em>Had\u012bth. In Had\u012bth parlance, a narrative which has just one narrator in any section of its chain is called <em>ghar\u012bb<\/em><sup data-fn=\"9deab55f-f479-4702-9935-e217ed87f9a2\" class=\"fn\"><a id=\"9deab55f-f479-4702-9935-e217ed87f9a2-link\" href=\"#9deab55f-f479-4702-9935-e217ed87f9a2\">1<\/a><\/sup>. It renders the narrative quite weak. It is only Ab\u016b Bakrah who reports this narrative at the top of this chain. The nature of the narrative is such that other companions too should have reported it from the Prophet (sws), but we find none.<\/p>\n\n\n\n<p>4. If the content of the Had\u012bth is analyzed, one can easily conclude that the Prophet (sws) could never have uttered these words. After all, success in this world was attained by many nations that had women rulers until the time of the Prophet (sws) and even after him.<\/p>\n\n\n\n<p>5. Last but not the least, this Had\u012bth is against the Qur\u2019\u0101n. It is the purport of the Qur\u2019\u0101n (42:38) that anyone who enjoys the confidence of the majority is eligible to become the ruler of the Muslims:<\/p>\n\n\n\n<p class=\"has-text-align-right\"><strong>\u0648\u064e\u0623\u064e\u0645\u0652\u0631\u064f\u0647\u064f\u0645\u0652 \u0634\u064f\u0648\u0631\u064e\u0649 \u0628\u064e\u064a\u0652\u0646\u064e\u0647\u064f\u0645\u0652<\/strong><\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>And their system is based on their consultation.<\/p>\n<cite> (42:38)<\/cite><\/blockquote>\n\n\n\n<p>The implication of this directive is that a Muslim government should be formed on the basis of a majority mandate, exist if it continues to enjoy this mandate and be deposed if it does not.<\/p>\n\n\n\n<p>Nowhere does the Qur\u2019\u0101n exclude women from this general principle.<\/p>\n\n\n\n<p>Another argument put forth by some against a woman head of state is that since Islam says that the head of a family should be a man and since a family is the basic unit of a state or society, therefore only a man should be the head of state.<\/p>\n\n\n\n<p>In this regard, it needs to be understood that a family structure and a state structure are inherently different from one another as far as governance is concerned.<\/p>\n\n\n\n<p>According to the Qur\u2019\u0101n (4:34), the head of a family is chosen on the basis of temperament and physical qualities and because of the fact that the head should be the breadwinner of the family. It says that men in general are more suited not only temperamentally and physically for this purpose, they have also been entrusted with the responsibility of earning for the family.<\/p>\n\n\n\n<p>On the other hand, as pointed out above, the head of a state should be a person who enjoys the confidence of the majority. This is a requirement of the Qur\u2019\u0101nic injunction \u201cTheir affairs are decided on the basis of mutual consultation, (42:38)\u201d. Hence, if a woman enjoys this confidence in some country, then, of course, it means that it is the will of the majority that a woman should rule it. In such cases, it is essential to follow the will of the majority.<\/p>\n\n\n\n<p>In other words, it can be said that since the criterion of selection of a head of a family is different to that of the selection of a head of state, one cannot analogously deduce a directive for one on the basis of the other.&#8221;<sup data-fn=\"fa4042f2-c400-4f7b-8f1b-e9826a513a8e\" class=\"fn\"><a id=\"fa4042f2-c400-4f7b-8f1b-e9826a513a8e-link\" href=\"#fa4042f2-c400-4f7b-8f1b-e9826a513a8e\">2<\/a><\/sup><\/p>\n<\/div>\n\n\n\n<p><strong>Another perspective<\/strong><\/p>\n\n\n\n<p>Furthermore, even if we accept the attribution of these words to the Prophet Muhammad (pbuh), it is crucial to consider that they were spoken in the context of the Sassanian Empire&#8217;s transition to female leadership. It is plausible that this statement by the Prophet (pbuh) was intended as a prediction about the political future of the Persian Empire rather than a general prohibition against women holding positions of authority. The Qur&#8217;an and Hadith frequently contain statements made in a general tone that refer to specific events. Therefore, this hadith cannot be regarded as a sufficient basis for prohibiting women from serving as heads of state.<\/p>\n\n\n\n<p><strong>Views of Muslim scholars<\/strong><\/p>\n\n\n\n<p>From the earliest periods of Islamic scholarship, even those jurists who accept the hadith in question as containing some form of injunction have varied in their interpretations of the phrase &#8220;placing affairs in the hands of a woman.&#8221; Some scholars argue for a complete prohibition of women holding any public office. On the contrary, Imam Abu Hanifa permits women to assume public roles, including serving as judges in cases where their testimony is admissible\u2014excluding cases involving fixed penalties (<em>hudud<\/em>) and retaliation (<em>qisas<\/em>). Imam Ibn Hazm, in his <em>Muhalla<\/em>, permits women to hold every public office except that of Head of State, drawing on this hadith as a basis. On the more permissive end of the spectrum, Hafiz Ibn Hajar, in <em>Fath al-Bari<\/em>, notes that Imam Ibn Jarir al-Tabari not only supports the unrestricted appointment of women as judges but also permits their appointment as Head of State.
