If there are three children\u2014two boys and one girl\u2014and one son has Down syndrome and requires lifelong 24-hour care (possibly for 70\u201380 years), the standard Shar\u012b\u02bfah distribution gives him only his fixed share. At most, he may receive slightly more through permissible arrangements. But if he realistically needs around 80% of the estate to survive with dignity, how does Islamic law address this situation?<\/p>\n\n\n\n\n\n\n\n

Answer<\/h4>\n\n\n\n

Thank you for writing to us. Islamic inheritance law (far\u0101\u02bei\u1e0d) is sometimes presented as a rigid arithmetic. Yet, the Qur\u02be\u0101n itself situates those rules within an ethic of compassion, especially in the passage urging believers to fear for the welfare of \u201cweak offspring\u201d (Qur’an\u00a04:9). What follows sets out (i) the default legal shares, (ii) the Qur\u02be\u0101nic and Prophetic mechanisms that allow a parent to protect a permanently\u2011disabled child, and (iii) the moral responsibility the family continues to shoulder once the estate has been distributed. The discussion reflects Ust\u0101d\u00a0Javed\u00a0A\u1e25mad\u00a0Gh\u0101mid\u012b\u2019s explanation of these verses and the broader spirit of Shar\u012b\u02bfah.<\/p>\n\n\n\n

1. The fixed shares<\/strong><\/p>\n\n\n\n

These shares are divinely guaranteed rights. They may not be overridden by fiat; to do so is labelled \u201ca great sin\u201d (Q 4:13\u201114). Nevertheless, the Qur\u02be\u0101n also commands believers to keep vulnerable people in mind while the estate is being organised (Q 4:8\u20119). Shar\u012b\u02bfah, therefore, provides several lawful instruments to channel additional resources to a disabled child without breaching anyone else\u2019s God\u2011given entitlement.<\/p>\n\n\n\n

2. Qur\u02be\u0101nic and Prophetic instruments for special\u2011needs care<\/strong><\/p>\n\n\n\n

The Prophet (sws) advised Sa\u02bfd b. Ab\u012b Waqq\u0101\u1e63 to keep his bequest to one\u2011third, \u201cand one\u2011third is still a lot,\u201d establishing a wise upper guideline<\/em>, not an immutable ceiling.<\/td>The father may bequeath, say, another 20 %\u201330 % of the estate to Son B, citing his lifelong dependency. A bequest that demonstrably preserves equity, and about which the other heirs may have been transparently consulted, fulfils both law and spirit.<\/td><\/tr>
Family consent (tar\u0101\u1e0d\u012b)<\/td>After the estate is divided, any heir may voluntarily cede all or part of his\/her share to a needy sibling (Q 4:8, 4:94).<\/td>The neuro\u2011typical son and the daughter can, by mutual agreement, redirect portions (or the entirety) of their own shares to Son B. Such consented re\u2011apportionment is commendable \u1e63adaqah<\/em> and does not violate far\u0101\u02bei\u1e0d.<\/td><\/tr>
Private family trust\/waqf dhurri<\/td>The father may earmark a property or fund as a waqf whose income covers Son B\u2019s care. When the beneficiary dies, the corpus passes to the surviving heirs or to another charitable purpose, as stipulated.<\/td>Modern jurisdictions recognise \u201cspecial\u2011needs trusts\u201d that achieve the same objective while safeguarding public\u2011benefit entitlements. Their Shar\u012b\u02bfah compliance hinges on the waqf\u2019s irrevocability and charitable intent.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n

A practical combination might be: (a) lifetime gift of the primary residence or income\u2011producing asset, covering a large chunk of the son\u2019s future expenses; (b) a waqf\/trust fed by additional savings and managed by the capable son as mutawall\u012b<\/em>; and (c) a will for contingencies. This structure fully respects the Qur\u02be\u0101nic shares yet secures the special\u2011needs child.<\/p>\n\n\n\n

3. Ongoing family duty after distribution<\/strong><\/p>\n\n\n\n

Even where finances are settled, Islam\u2019s vision of \u02bf\u0101\u02beilah<\/em> (the extended household) demands more than paying a bill and walking away. Siblings are morally\u2014and in classical fiqh, in certain schools, legally\u2014obliged to maintain a destitute brother who cannot fend for himself. Gh\u0101mid\u012b often reminds audiences that the Shar\u012b\u02bfah injunctions are intended to be enacted within a culture of mercy and mutual service, not adversarial individualism.<\/p>\n\n\n\n

Accordingly, parents should cultivate in their other children an ethic of guardianship, not mere tolerance. They should be prepared to:<\/p>\n\n\n\n

  1. Serve as legal guardians or co\u2011trustees, ensuring professional carers, medical oversight, and dignified living conditions for Son\u00a0B.<\/li>\n\n\n\n
  2. Review the trust\u2019s performance periodically and top up if investments underperform relative to inflation and longevity risk.<\/li>\n\n\n\n
  3. Engage the wider family (uncles, aunts, cousins) in a rota of emotional and social support, mirroring the Prophet\u2019s (sws) statement:\u00a0\u201cThe most beloved of people to God are those who bring most benefit to others.\u201d<\/em><\/li>\n<\/ol>\n\n\n\n

    Such a collective posture transforms inheritance from a zero\u2011sum division into an ongoing project of i\u1e25s\u0101n<\/em>.<\/p>\n\n\n\n

    4. Concluding counsel<\/strong><\/p>\n\n\n\n

    Islamic law sets the floor of justice through fixed shares, but it urges the believing family to rise above that floor when an heir\u2019s survival and dignity are at stake. Through judicious hibah<\/em>, an ethically grounded wa\u1e63iyyah<\/em>, or a carefully crafted family trust, combined with the siblings\u2019 willing cooperation, the estate can lawfully channel whatever part is required to the son with Down syndrome without encroaching on anyone\u2019s rights.<\/p>\n\n\n\n
