What follows sets out (i) the default legal shares, (ii) the Qur\u02be\u0101nic and Prophetic mechanisms that allow a parent to protect a permanently\u2011disabled child, and (iii) the moral responsibility the family continues to shoulder once the estate has been distributed. Their Shar\u012b\u02bfah compliance hinges on the waqf\u2019s irrevocability and charitable intent.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>A practical combination might be: (a) lifetime gift of the primary residence or income\u2011producing asset, covering a large chunk of the son\u2019s future expenses; (b) a waqf\/trust fed by additional savings and managed by the capable son as&nbsp;<em>mutawall\u012b<\/em>; and (c) a will for contingencies. This structure fully respects the Qur\u02be\u0101nic shares yet secures the special\u2011needs child.<\/p>\n\n\n\n<p><strong>3. Ongoing family duty after distribution<\/strong><\/p>\n\n\n\n<p>Even where finances are settled, Islam\u2019s vision of&nbsp;<em>\u02bf\u0101\u02beilah<\/em>&nbsp;(the extended household) demands more than paying a bill and walking away. Siblings are morally\u2014and in classical fiqh, in certain schools, legally\u2014obliged to maintain a destitute brother who cannot fend for himself. Gh\u0101mid\u012b often reminds audiences that the Shar\u012b\u02bfah injunctions are intended to be enacted within a culture of mercy and mutual service, not adversarial individualism.<\/p>\n\n\n\n<p>Accordingly, parents should cultivate in their other children an ethic of guardianship, not mere tolerance. They should be prepared to:<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li>Serve as legal guardians or co\u2011trustees, ensuring professional carers, medical oversight, and dignified living conditions for Son\u00a0B.<\/li>\n\n\n\n<li>Review the trust\u2019s performance periodically and top up if investments underperform relative to inflation and longevity risk.<\/li>\n\n\n\n<li>Engage the wider family (uncles, aunts, cousins) in a rota of emotional and social support, mirroring the Prophet\u2019s (sws) statement:\u00a0<em>\u201cThe most beloved of people to God are those who bring most benefit to others.\u201d<\/em><\/li>\n<\/ol>\n\n\n\n<p>Such a collective posture transforms inheritance from a zero\u2011sum division into an ongoing project of&nbsp;<em>i\u1e25s\u0101n<\/em>.<\/p>\n\n\n\n<p><strong>4.
